If you're arrested with a blood alcohol concentration (BAC) of 0.08% or higher, Nevada law stipulates the following potential penalties for a first offense DUI:
Jail Time: Minimum of 2 days up to 6 months, or 96 hours of community service in lieu of jail time.
Fines: Between $400 and $1,000, plus court costs and administrative fees.
DUI School: Mandatory completion of an 8-hour DUI education course or a substance abuse program at your expense.
Victim Impact Panel: Required attendance at a panel presented by victims of drunk driving incidents.
Ignition Interlock Device (IID): Installation in your vehicle for 3 to 6 months.
If your BAC was 0.18% or higher, enhanced penalties may apply, including:
IID Installation: Required for 12 to 36 months.
Alcohol Treatment Program: Mandatory enrollment in a state-approved treatment program.
In addition to criminal penalties, the Nevada Department of Motor Vehicles (DMV) may impose administrative actions:
License Revocation: A first-time DUI conviction results in a 185-day license revocation.
Restricted License: After 90 days, you may be eligible for a restricted license, allowing you to drive to work or school, provided you install an IID.
