If you're arrested with a blood alcohol concentration (BAC) of 0.08% or higher, and it's your second DUI offense within seven years, Nevada law stipulates the following potential penalties:

  • Jail Time: Minimum of 10 days up to 6 months, or residential confinement.

  • Fines: Between $750 and $1,000, plus court costs and administrative fees.

  • DUI School: Mandatory completion of an 8-hour DUI education course or a substance abuse program at your expense.

  • Victim Impact Panel: Required attendance at a panel presented by victims of drunk driving incidents.

  • Ignition Interlock Device (IID): Installation in your vehicle for 6 to 12 months.

If your BAC was 0.18% or higher, enhanced penalties may apply, including:

  • IID Installation: Required for 12 to 36 months.

  • Alcohol Treatment Program: Mandatory enrollment in a state-approved treatment program.

Driver's License Suspension

In addition to criminal penalties, the Nevada Department of Motor Vehicles (DMV) may impose administrative actions:

  • License Revocation: A second DUI conviction results in a one-year license revocation.

  • Restricted License: After a certain period, you may be eligible for a restricted license, allowing you to drive to work or school, provided you install an IID.
